ABSTRACT. The establishment of a mandatory notarial form for real estate donation agreements in Russian civil legislation makes it relevant to conduct a more in-depth analysis of the norms of this institution, to study its origins and development prospects. The origins of giving, the study emphasizes, lie in the Christian idea of sacrificial charity, voluntariness, selflessness and nobility. Over time, the donation agreement increasingly began to acquire the character of a “dangerious transaction”, which required the establishment of a mandatory notarial form for it. The analysis of the judicial practice of invalidating a real estate donation agreement leads to the conclusion that it is necessary for notaries in each specific case to take a more thorough approach to identifying the real will of the donor, symbolizing solely his generosity. It seems promising to create mechanisms to protect the interests of the donor, including the development of a category of ingratitude of the donee, which would cover not only the commission of illegal acts, but also actions that violate moral norms, which attach special importance to the values of goodness, honor and dignity of the individual.
