ABSTRACT. The article examines the legal regulation of closed wills as an independent institution of Russian inheritance law. Based on the analysis of current legislation, doctrinal positions and judicial practice, systemic gaps of Article 1126 of the Civil Code of the Russian Federation are identified: the absence of a mechanism for verifying the testator’s legal capacity, the unresolved situation regarding wills drafted in a foreign language, restrictions on the range of eligible persons, and conflicts with the institutions of joint spousal wills and inheritance contracts introduced in 2019. A comparative legal analysis of closed will regulation in Russia, France, Germany and CIS countries has been conducted. Based on the research findings, the author puts forward proposals for improving legislation aimed at ensuring a balance between the principle of testamentary secrecy and the need to protect the rights of participants in hereditary legal relations.
