В статье представлены результаты обобщения практики применения статьи 431.2 Гражданского кодекса Российской Федерации. Выделены признаки заверений, проанализированы требование их явности и недвусмысленности, а также формы и способы их предоставления. Исследование практики показало, что постепенно вырабатывается стандарт добросовестности поведения получателя заверений. Рассмотрена проблема отказа от заверений.

ENFORCEMENT OF THE NORMS OF ARTICLE 431.2 OF THE CIVIL CODE OF THE RUSSIAN FEDERATION IN JUDICIAL PRACTICE

The article provides the results of the overview of the practice regarding the application of Article 431.2 of the Civil Code of the Russian Federation. The signs of representations about circumstances and the requirements of their clarity and unambiguity are analyzed, as well as the forms and ways of their provision. The study of practice has proven that a standard of conduct in good faith for the recipient of representations is gradually being developed. The problem of refusal of representations is also considered.
