Авторы исследуют содержание и значение отдельных функций нотариата в сфере наследственного права. В статье анализируется понятие функций нотариата в юридической науке. Авторы отмечают, что реализация функций нотариата в вопросах наследования имеет особое значение. Авторы раскрывают сущность правозащитной, предупредительно-профилактической (превентивной), правоохранительной, правоустановительной и фискальной функций нотариата в сфере наследственного права. В статье приводятся позиции высших судебных инстанций, затрагивающие вопросы реализации функций, возложенных на нотариуса в связи с публично-правовым характером его деятельности. Авторы приходят к выводу о том, что функции нотариата определяют ключевое значение деятельности нотариуса в отношениях по наследованию.

ABSTRACT. The authors explore the content and significance of individual notary functions in the field of inheritance law. The article analyzes the concept of notary functions in legal science. The authors note that the implementation of notary functions in inheritance matters is of particular importance. They explore the nature of the notary’s advocacy, preventative, law enforcement, law-establishing, and fiscal functions in inheritance law. The article presents the positions of the highest judicial authorities regarding the implementation of functions assigned to notaries due to the public law nature of their activities. The authors conclude that the functions of notaries determine the key importance of their activities in inheritance matters.
