В статье рассматривается устройство нотариата Южной Кореи с точки зрения ретроспективы и до современности. Обозначен факт заимствования норм о нотариате из японского нотариального законодательства. Прослежены параллели с немецким нотариатом в аспекте функционирования института адвоката-нотариуса. Отмечено наличие в Южной Корее уникальной трехзвенной системы нотариата, изменившейся в ходе реформ. Выявлено наличие административного элемента в устройстве нотариата Южной Кореи вместе с общим тождеством нотариата данного типа модели латинского нотариата.

GENESIS OF THE NOTARIAT IN SOUTH KOREA

ABSTRACT. The article considers the structure of the notariat of South Korea from the point of view of retrospect and up to the present day. The fact of borrowing of norms on notariate from Japanese notarial legislation is outlined. Parallels with the German notariat in the aspect of functioning of the institute of lawyer-notary are traced. It is noted that South Korea has a unique three-tier system of notariat, which has changed in the course of reforms. The presence of an administrative element in the structure of the South Korean notariat is revealed along with the general identity of this type of notariat with the model of the Latin notariat.
