Предусмотренные сегодня законодательством и успешно применяемые на практике модели контроля в системе российского частного нотариата необходимым образом учитывают его дуалистическую природу, позволяют успешно сочетать государственный (административный и судебный) и профессиональный контроль, обеспечивая независимость нотариусов и защиту прав граждан и организаций. В статье выделяются преимущества профессионального контроля за исполнением нотариусами своих обязанностей, обосновывается, что сложившееся и легально закрепленное распределение полномочий по контролю между органами государственной власти и нотариальными палатами в достаточной мере позволяет реализовать свойственные системе частного нотариата принципы.

PROFESSIONAL CONTROL IN THE NOTARY COMMUNITY: REALITIES AND PROSPECTS

ABSTRACT. The control models provided for by legislation today and successfully applied in practice in the Russian private notary system take into account its dualistic nature; they allow for a successful combination of state (administrative and judicial) and professional control, ensuring the independence of notaries and the protection of the rights of citizens and organizations. The article highlights the advantages of professional control over the performance of their duties by notaries. It is proved that the established and legally fixed distribution of control powers between public authorities and notary chambers sufficiently allows the implementation of the principles inherent in the private notary system.
