В статье рассмотрены актуальные вопросы нотариальной практики, возникающие при нотариальном удостоверении заявления участника общества о выходе из общества в условиях моратория на возбуждение дел о банкротстве по заявлениям, подаваемым кредиторами. На основе анализа нормативных актов, судебной практики и доктрины автор предлагает конкретные практические рекомендации для нотариусов.

TOPICAL ISSUES OF NOTARIZATION OF THE COMPANY MEMBER’S APPLICATION FOR WITHDRAWAL FROM THE COMPANY

ABSTRACT. The article deals with topical issues of notarial practice arising from the notarization of applications of a company participant to withdraw from the company under conditions of moratorium on initiation of bankruptcy proceedings submitted by creditors. Based on the analysis of the normative acts, judicial practice and doctrine, the author offers some specific practical recommendations for the notaries.

В статье рассмотрены актуальные вопросы нотариальной практики, возникающие при нотариальном удостоверении сделок с участием иностранных лиц, заключаемых в условиях санкций недружественных государств в отношении Российской Федерации.

На основе анализа нормативных актов, практики и доктрины авторы предлагают конкретные практические рекомендации для нотариусов.
