Настоящая статья подготовлена на основе доклада и выводов научно-практической дискуссии, проведенной Федеральной нотариальной палатой 22 ноября 2023 года в формате круглого стола “Вопросы банкротства в нотариальной практике”. Автором рассматриваются некоторые проблемные вопросы, возникающие у нотариусов при оформлении документов физических лиц, находящихся в процедуре банкротства, и даются практические рекомендации. Имея большой практический опыт оформления документов по обозначенному вопросу, автор приходит к выводу о коллизии норм права и вносит предложения по совершенствованию законодательства.

Some problematic issues of performing notarial actions with the participation of citizens in respect of whom bankruptcy proceedings have been initiated

ABSTRACT. This article was prepared on the basis of the report and conclusions of a scientific and practical discussion held by the Federal Notary Chamber on November 22, 2023 in the round table format “Bankruptcy Issues in Notarial Practice”. The author examines some problematic issues that notaries encounter when preparing documents for individuals undergoing bankruptcy proceedings, and gives practical recommendations. Having extensive practical experience in preparing documents on this issue, the author comes to the conclusion about a conflict of laws and makes proposals for improving legislation.

В настоящей статье рассмотрены основные особенности совершения нотариальных действий с участием физических лиц, в отношении которых введена процедура банкротства. Авторами проанализированы стадии процесса банкротства, обозначены правовые последствия признания лица банкротом, даются практические рекомендации нотариусам.

ABSTRACT. This article analyzes the features of notarial activity with the individuals in respect of whom the bankruptcy procedure has been introduced. The authors highlight the stages of the process of bankruptcy, identified the legal consequences of declaring a person bankrupt and gave practical recommendations to notaries.

В статье анализируется процедура совершения нотариальных действий с участием юридических лиц, находящихся в процессе банкротства. Авторы акцентируют внимание на коллизионных нормах, проблемах правоприменения, дают практические рекомендации.
